An Area Court sitting at Centre Igboro in Ilorin, Kwara State, has dissolved the Islamic marriage between Toyin Ajibola and Bashirat Mohammed after the wife sought separation over financial hardship.
The ruling was delivered by the presiding judge, Hammad Ajumonbi, who held that although the husband wanted the marriage to continue, the wife had made it clear she wished to move on.
The court therefore granted the divorce and ended the union.
Custody of the three children from the marriage was awarded to the wife.
The judge also directed the woman to observe the three month iddah waiting period in line with Islamic marital procedures before entering another marriage.
In addition, the court ordered the husband to remain responsible for the feeding and welfare of the children.
The judge stated that the father should have unrestricted access to his children, while the mother must make them available whenever he requests to see them.
During proceedings, Bashirat told the court that she was tired of the marriage because of persistent lack of money and what she described as her husband’s irresponsibility.
She asked the court to dissolve the marriage so she could have peace of mind.
Responding, the husband said he still loved his wife and wanted the marriage to continue.
He admitted facing serious financial difficulties and said he had been trying to provide for his family but had not been successful.
He also said it was painful that he could not afford to visit his wife and children after they left the home.
